Terms and Conditions

§ 1 Scope

These Terms and Conditions apply to all orders placed through the online shop of Adventure to Color (hereinafter referred to as the “Provider”).

Consumers within the meaning of these Terms and Conditions are natural persons who place orders for purposes that are predominantly neither commercial nor self-employed in nature.

§ 2 Formation of Contract

The display of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

By clicking the “Add to Cart” button and subsequently confirming the purchase, the customer submits a binding offer to purchase the selected product. The acceptance of the offer takes place through an order confirmation email from the Provider or by making the download link available.

§ 3 Prices and Payment Terms

All stated prices are final prices inclusive of any legally applicable value added tax.

Payment is made via the payment methods available in the shop (e.g. credit card, PayPal). Payment is due immediately upon completion of the order.

§ 4 Digital Products and Delivery

The products offered are exclusively digital content (PDF files). No physical delivery takes place.

Upon successful receipt of payment, the customer will receive a download link by email and via the order confirmation page. Access to the files is generally granted immediately after payment confirmation.

The customer is entitled to print the downloaded files for private, non-commercial use. Sharing, reselling or any commercial use of the content is strictly prohibited.

§ 5 Right of Withdrawal and Exclusion

Consumers are generally entitled to a statutory right of withdrawal. For digital content not delivered on a physical medium, the right of withdrawal expires once the Provider has begun performance of the contract and the consumer has expressly agreed that the Provider may begin performance before the withdrawal period has expired, and has confirmed their awareness that they lose their right of withdrawal by giving such consent.

By completing the order and accepting these Terms and Conditions, the customer expressly agrees that the download link will be made available immediately upon receipt of payment, and acknowledges the resulting loss of the right of withdrawal.

§ 6 Voluntary 30-Day Money-Back Guarantee

Notwithstanding the statutory right of withdrawal, Adventure to Color voluntarily offers a 30-day money-back guarantee. If the customer is not satisfied for any reason, they may contact us within 30 days of the purchase date by email at t56uk9v@gmail.com. The Provider will refund the purchase price without further questions.

This voluntary guarantee does not create any additional statutory rights and does not affect the customer's statutory warranty rights.

§ 7 Copyright and Usage Rights

All digital content offered in the shop (coloring books, coloring pages, PDF files) is protected by copyright and is the property of Adventure to Color.

Upon purchase, the customer receives a simple, non-transferable licence for private use. This includes the right to print the files for personal household use an unlimited number of times. The following is strictly prohibited:

•      Sharing or selling the files to third parties

•      Commercial use (e.g. selling printed copies)

•      Publishing the files on the internet or on social media

•      Editing or modifying the content

§ 8 Limitation of Liability

The Provider is liable without limitation for damages caused by intentional or grossly negligent conduct, as well as for damages arising from injury to life, body or health.

In all other respects, the Provider's liability is excluded, in particular for technical problems with the download that are outside the Provider's control.

§ 9 Privacy

The Provider processes the customer's personal data exclusively for the purpose of processing the purchase contract and providing the download. Further information on data protection can be found in our Privacy Policy.

§ 10 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr. The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Applicable Law

The law of the Republic of Slovenia applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the customer is habitually resident remain unaffected.

§ 12 Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
